May 2008

May is the birthday month of the LCRI and this year we celebrated our fifth anniversary with a party! Clinic members came from a wide swath of past experience, some from the very first days of the clinic all the way through to this year's class, including Valeria Ilareva and Dinko Dinev, founding members. While the LCRI began in 2001, it was May 22, 2003 that the official statute of the LCRI was signed, and a number of those signatories made it to the party! Also in attendance were clients and supporters, all sharing experiences, stories, and a good time.

It was also a celebratory month in terms of the release after more than two years in detention of an Afghani asylum seeker who has worked vocally and very hard to express the migrant perspective, to document his experience, and to call for change and the respect of basic rights for migrants in Bulgaria. While we are pleased to see him, there remain many others in dire need of help, and we continue to focus on substantive change and look forward to enlisting greater numbers of students in the provision of assistance through the LCRI.

We are also concerned for the situation facing immigrants detained at the Lyubimets Detention Centre, which has recently facilitated the deportation of a number of Iranian asylum seekers, and we are working to establish lasting contact there.

On May 12th the LCRI was proud to be represented at the concluding event of a project the LCRI has been involved in with the Economic Policy Institute in partnership with the German Marshall Fund. The event celebrated the release of the book "The Implication of EU Membership on Immigration Trends and Immigrant Integration Policies for the Bulgarian Labor Market" towards which Themba Lewis and Diana Daskalova contributed a chapter analyzing legal obstacles in migrant access to effective livelihood through the labor market.

Themba and Diana also represented the LCRI at the "Integrating (New) Migrants: European Experiences" International Conference hosted by the Manfred Worner Foundation and the Center for European Refugee, Migration, and Ethnic Studies (CERMES) at New Bulgarian University. This conference brought together presenters from all over Europe and was supported by the 2004 PHARE Civil Society Development Program.

Clinic Cases Developments:

• Two decisions of the Administrative Supreme Court revoking denials of the State Agency of refugee status to clients from Cuba, and one decision confirming a denial of the State Agency at first instance of appeal.
• We have one very good decision of the Sofia Administrative Court reversing a detention order after 2 years of detention and one reversing a denial of the administrative authority to change effective detention into a lighter measure (daily signing at a police department) after more than two years detention. Both cases will probably be appealed by the Direction of Migration at the Supreme Administrative Court.
• The disturbing decision of the Administrative Supreme Court (ASC), stating a claim against a detention order not admissible in a separate court review at all, continues to be confirmed by the Supreme Court in three more following decisions!!
• We are happy to share that as a result of the help of the clinic a separated family (a Bulgarian wife and a Lebanese husband) were happily brought together with successful application for visa "D" of the husband, after his forcible detention in Busmantsi center and subsequent deportation to Lebanon. The family had their first baby born while the husband was still in Lebanon. Now the three of them are together in Bulgaria!

March 2008

The LCRI is pleased to celebrate the release, after nearly four years in detention, of a Cuban immigrant from the Busmanci immigration detention center. This case highlights the overdue need for Bulgaria to recognize its obligation to protect human freedoms and join its European counterparts in placing limitations on the duration of administrative detention. Such a case demands reflection from all of us, and demonstrates the necessity for change. Change needs to manifest in many ways, and the LCRI is pleased this month to have made progress in drawing the attention of the wider European community to rights abuses facing immigrants, refugees, and asylum-seekers Bulgaria.

LCRI lawyer Valeria Ilareva, accompanied by Dr. Maria-Teresa Gil-Bazo, was granted a meeting with the European Parliament Committee on Civil Liberties, Justice and Home Affairs in Brussels. The meeting was hosted by the Chair of the Committee and was attended by a number of other interested parties, providing an unprecedented opportunity for the LCRI to present the Bulgarian case to members of the European Parliament. Meanwhile, our case before the European Court of Human Rights progresses, drawing increasing interest and concern. The case challenges the extended solitary confinement (over 10 months in duration) of a Chechen torture survivor detained at the Busmanci center. The Court applied Rule 40 of the Rules of the Court, designating the case as urgent and informing relevant parties of the lodging of the application and the objections raised. While the case has a long way to go, on April 2, 2008 the detention authorities ended the solitary confinement of our client.

In Sofia, LCRI lawyer Diana Daskalova and coordinating member Nezabravka Vazelova participated in the round table discussion, "Immigration in between Human Rights and Security Issues" coordinated by the Manfred Worner Foundation. Also in March, LCRI lawyer Diana Daskalova received confirmation that she had been selected as one of only 60 nominees to participate in the Transatlantic Forum for Young Professionals in Migration and Integration organized by the German Marshall Fund to take place at Castle Pommersfelden near Nuremberg, Germany, from July 9-13, 2008.

Finally, all of us at the Clinic would like to thank the International Women's Club of Sofia for making possible the participation of four Clinic members in the upcoming International Moot Court Competition in Brno, Czech Republic! This is a fabulous development and we are thrilled to be able to take part in it. THANK YOU, IWC!

April 2008

The LCRI teams have returned from the International Moot Court Competition in Brno, Czech Republic with rankings of First Place and Third Place! Needless to say, we are very proud of our teams and they worked very hard for their achievement. The competition was a lot of fun and we are grateful to the International Women's Club of Sofia for making it possible for us.

Meanwhile, in Sofia, the LCRI is settling into a new office located just minutes from Orlov Most. While we still hope to return to the University for many reasons, the new space offers some valuable aspects, such as a private meeting room, all-hours accessibility, and a very central location.

The European Court of Human Rights case continues to develop, and has been gaining significant international attention. On April 18th Amnesty International issued a global 'Urgent Action' campaign on behalf of our client, and followed this with a strong open letter of concern. Only ten days previous, the European Parliament sent a similar letter of concern to the Chairman of the Committee on Human Rights and Religious Affairs of the Bulgarian Parliament. While these developments are significant, the Migration Directorate is only directly accountable to its Bulgarian supervision, and there has been no substantive change to the conditions facing our client or others in administrative detention in Bulgaria. These are urgent cases and they demand greater public attention and legislative reform. All people deserve justice, qualified representation, and the realization of their rights!

Февруари 2008

Въпреки практическите трудности, създадени поради липсата на централен офис, Клиниката направи значителни стъпки за постигането на своите стратегически краткосрочни и дългосрочни цели през месец февруари, както на местно, така и на международно равнище. Месецът започна с набиращия скорост първи случай на Клиниката пред Европейския съд по правата на човека. Делото се води с упоритата работа и усилия на Чанита Ангелова, Иво Стефанов и Валерия Иларева и със съдействието на Центъра за подпомагане на хора, преживели изтезание (ACET) в София и AIRE Centre в Лондон. В момента Съдът събира факти по делото и разглежда подадените от нас документи.

На национално ниво Клиниката спечели дело, поставящо прецедент, пред българската Комисия за защита от дискриминация, чрез което се стремяхме да докажем, че затварянето в изолатор се налага на дискриминационен принцип спрямо задържаните имигранти. Същевременно, Клиниката работи в насока за създаване на система за периодичен преглед на задържането и разработва модел за молба, въз основа на международното право (Бългаското законодателство не предвижда процедура за периодичен преглед на задържането).

На 18 и 19 февруари Клиниката все участие в конференцията " Участието на неправителствените организации за улесняване интегрирането на мигрантите в Европа", представена в София и организирана от Фондация Манфред Вьорнер (Manfred Worner Foundation) и CERMES.

През месец февруари също така приключи обучителния курс и подготовката за поемане на случаи на новите членове на Клиниката. Някои от тях вече започнаха работа по случаи, а останалите ще поемат такива в най- скоро време. Наред с това, четирима членове на Клиниката ще участват в Международното състезание по бежанско право, което ще се проведе в Бърно, Чехия. Те вече подадоха своите писмени защити и се подготвят за устните кръгове през месец април. Освен това Отборът за състезанието Джесъп (Jessup) за 2008, включващ членовете на Клиниката Николай Илчев, Оля Николова, Владислава Стоянова и Мария Ковалакова, се подготвят да представят България на 49-тото състезание по международно право във Вашингтон. Освен това, през април 2008 год. България ще бъде представлявана на ТЕЛДЪРС състезанието по международно право, което се провежда в Хага. Трима студенти от четири членния български отбор са от Клиниката – Ралица Виячка, Крум Христов и Николай Драгов. Клиниката с гордост подкрепя членовете си, които вземат участие в международни форуми. Клиниката се гордее с възможността да подкрепи своите членове.

Развитие по случаите през месец февруари:
• Клиниката защитава търсещ убежище от Ирак, който е бил преследван, защото е работил като преводач на коалиционните сили. Защитата бе срещу решениe за прекратяване на процедурата за определяне на бежаски статут и срещу издадената заповед за депортиране.

• Клиниката пое защитата по драматичен случай на разделено семейство, в който съпругата и двете деца са български граждани, а съпругът е депортиран в Ливан. Във връзка с този случай адвокатът на Клиниката Диана Даскалова взе участие в телевизионно предаване.
• Петима клиенти на Клиниката бяха освободени от дома за временно настаняване в Бусманци - 1 от Западна Сахара, 3 от Палестина и 1 от Китай.

• Софийският административен съд излезе с две положителни решения, отменяйки две решения за задържане на граждани на Куба. В момента решенията на Съда се обжалват от Дирекция Миграция пред ВАС, но все пак и това е победа.

February 2008

Despite the practical difficulties of working without a centralized office, the Clinic has made considerable strides towards its strategic short and long-term goals in February. These have been both on the local and international level, and the month opened with increased momentum in the Clinics first case before the European Court of Human Rights. The case is developing with the hard work and persistent efforts of Chanita Angelova, Ivo Stefanov, and Valeria Ilareva, and has gone forward with the cooperation with the Assistance Center for Torture Survivors (ACET) in Sofia and the AIRE Centre in London. The court is currently compiling and reviewing our submission.

On the national level, the Clinic realized the defense in a precedent-setting case at the Bulgarian Commission for Protection against Discrimination where we have strived to prove that solitary confinement is applied to immigration detainees in a discriminatory way. Simultaneously, the Clinic is working to create a system for the periodic review of detention and is developing a model 'request' based in international law (Bulgarian law does not provide for a procedure for periodic review of detention).

On the 18th-19th of February, the Clinic participated at the "NGO Participation in the Facilitation of European Integration of Migrants" conference, presented in Sofia and organized by Manfred Worner Foundation & CERMES.

February also saw the 2008 Clinic class winding up it's coursework and preparing to take cases. Some of the new students have already begun work on cases, and the rest will shortly! Simultaneously, four Clinic members set to participate in the International Asylum Law Moot Court Competition upcoming in Brno, Czech Republic, submitted their written memorials and are preparing to defend them in April. In addition, the 2008 Jessup Team, comprised of Clinic members Nikolai Ilchev, Olia Nikolova, Vladislava Stoyanova, and Maria Kovalakova are preparing to represent Bulgaria at the 49th International Law Moot Court Competition in Washington, D.C. Simultaneously, the 2008 Telders International Law team is preparing to take on teams from all over Europe at the Hague. The four-person team hosts three Clinic members - Ralitsa Viyachka, Krum Hristov, and Nikolay Dragov. The Clinic is proud to support our members as they fan out across the globe!

Some case developments in February:
• The Clinic realized the defense of an Iraqi asylum seeker, persecuted in Iraq for serving as a translator for the coalition forces, against the decision for discontinuance of his Refugee Status Determination procedure and against his deportation order.
• The Clinic realized the defense in a dramatic case of family separation in which the wife and two minor children are Bulgarian citizens and the husband was deported to Lebanon. Clinic lawyer Diana Daskalova participated in a television program related to this case.
• 5 Clinic clients were released from the detention center in Busmantsi - 1 from West Sahara; 3 from Palestine; 1 from China.
• Two positive decisions came through from the Sofia Administrative Court, reversing two detention orders against Clinic clients from Cuba. The decisions are appealed in front of the Supreme Court from the Direction of Migration, but it is still a victory!

Януари 2008

Новата година настъпи с нови предизвикателства и позитивни развития за Правната клиника за бежанци и имигранти, така като всяка нова година трябва да започва!
Новата година започна с публикация на интервю с главния адвокат на Клиниката Диана Даскалова в списаниято Обектив, което се издава от Български хелзинкски комитет. Интервюто беше фокусирано върху съдбата на задържаните имигранти в България.

Клиниката беше поканена да участва в състезанието по бежанско право, което ще се проведе в Бърно, Чехия. Атанас Събев, Светлана Стаменова, Мария Петрова и Петя Пишмишева ще бъдат представителите на България на състезанието и са готови за предизвикателствата, които ги очакват! Състезанието се организира от Обществото на граждани помагащи на мигранти в Бърно (Society of Citizens Assisting Migrants (SOZE), и под ръководството на Унгарския хелзинкски комитет.

Освен това, през януари започна неформално сътрудничество между Правната клиника и Центъра за социална справедливост (Center for Social Justice) в Seton Hall University Faculty of Law, Ню Джърси, САЩ. Очакваме полезно и интересно сътрудничество!

Загубата на нашия офис в Юридическия факултет на Софийския университет беше, за съжаления, най-важното събитие за януари. Това се случи без обяснение от страна на факултета. Много сме разтревожени, че по никакъв начин не бяха взети под внимание последствията за много хора от тези действия. Клиниката стана по-силна и продължава да функционира (провеждат се часове, предоставя се безплатна правна помощ на клиенти). Продължава работата по национални и международни дела на клиенти. Обучението на новите членове на Клиниката ще бъде довършено. Подкрепата от студентите е изключително силна. Благодарни сме и на подкрепата от други неправителствени организации. С нетърпение очакваме да се върнем в офиса си!

The New Year has begun with its fair share of challenges and positive developments at the Legal Clinic for Refugees and Immigrants, as any new year should!
The year began with the publication of a panel interview featuring Clinic Lawyer Diana Daskalova in the magazine Objektiv, published by the Bulgarian Helsinki Committee, and focusing on the circumstances facing migrants in detention in Bulgaria.

In an exciting international development, the Clinic has been invited to participate in the 2008 International Asylum Law Moot Court Competition in Brno, Czech Republic. Clinic members Atanas Sabev, Svetlana Stamenova, Maria Petrova, and Petya Pishmisheva will represent Bulgaria at the competition, and are already hard at work in preparation! The competition is being organized by the Society of Citizens Assisting Migrants (SOZE) in Brno, and is being reviewed by the Hungarian Helsinki Committee.

Additionally, January saw the inauguration of an informal partnership between the Clinic and the Center for Social Justice at Seton Hall University Faculty of Law in New Jersey, USA. We look forward to in informative and engaging international friendship!

The loss of our office in the Faculty of Law at Sofia University was, unfortunately, the defining event of January. The closure was made without explanation by the faculty, and left us alarmed by the brazen lack of regard for the potential human consequences of such an action. The Clinic has drawn a good deal of strength from the event, and continues to function (teaching classes, assisting clients, and providing free legal aid) in the meantime, with significant local and international cases moving forward and a dedicated class of new members in the final weeks of Clinic classes. Student support has been overwhelming, and support from the NGO community and others has heartened us greatly. We look forward to moving back in to a centralized office soon!

Радваме се да Ви представим първия от месечните ни осведомителни доклади за дейността на Правната клиника за бежанци и имигранти (ПКБИ).

Октомври 2007

Октомври беше вълнуващ месец на промени за Клиниката. Нашият адвокат Валерия Иларева замина за една година в Мадрид, Испания, където провежда научноизследователска дейност, свързана с докторската й дисертация. Въпреки че присъствието й в Клиниката ни липсва, тя продължава да работи по много от случите и да развива нови инициативи. Темба Луис се присъедини към Диана Даскалова, заемайки длъжността на мениджър на ПКБИ и допринасяйки за повишаването на ефективността в ежедневните дейности на Клиниката и стратегическото дългосрочно планиране. В същото време приема на нови членове имаше като резултат появата на нови лица в ПКБИ и донесе нова енергия, която да допълни опита, натрупан от дългогодишните ни членове.

Незабравка Възелова и Темба Луис участваха като представители на Клиниката в срещите относно „Интеграция и правата на имигрантите" и „Трудов пазар" по време на семинара „Интеграцията на имигранти и техните сдружения", организиран от Фондация „Манфред Вьорнер" и Център за европейски бежански, миграционни и етнически изследвания (ЦЕБМЕИ), проведен в Клуб Владая. Конференцията събра представители на имигрантските общности и хора от обслужващата сфера, които обсъдиха изключително сериозни проблеми, пред които са изправени имигрантите и организациите. Това позволи да се установят връзки за последваща комуникация и помощ.

Нaред с това, в отговор на жалба, подадена от адвоката на Клиниката Валерия Иларева, в която се описват правонарушенията и възпрепятстването на достъпа до Дома за временно настаняване на чужденци в Бусманци, Софийската адвокатска колегия предприе през окомври процедура по сезирането на Висшия съдебен съвет за обявяването за противоконституционно възпрепятстването на достъпа до документите на задържаните лица в Бусманци.

Ноември 2007

Ноември започна с отблязване освобождаването от дома в Бусманци на двама от клиентите на Клиниката. Единият от тях е бил задържан повече от две години, а другият – повече от шест месеца.

На 7.11.2007 г. Клиниката имаше честта да бъде поканена да участва в обществения дебат „Да си бежанец в България", в който бяха обсъдени проблемите на принудителното задържане и условията в СДВНЧ - Бусманци. Домакин на събитието беше Центърът за култура и дебат „Червената къща", а спонсор и организатор - Център за европейски бежански, миграционни и етнически изследвания (ЦЕБМЕИ) към Нов Български Университет с помощта на Обединението за гражданско общество в Централна и Източна Европа. Незабравка Възелова представи Правната клиника, а Питър Чикой (доброволец, клиент на ПКБИ) запозна присъстващите с положението на принудително задържаните.

През ноември започнаха и лекциите на 17 ентусиазирани нови членове на Клиниката. Тези занимания ще се съсредоточат върху международните и българските правни стандарти в областта на човешките права, бежанско имиграционно право, както и да запознят студентите със специфични аспекти от миграционната практика - работата с хора, преживели насилие, и динамиката в сферата на международната хуманитарна помощ и организациите, работещи в нея.

През ноември статията "Отношението на България към търсещите убежище"на Валерия Иларева беше публикувана в авторитетния международен журнал „Forced Migration Review". Изданието излиза на френски, английски, испански и арабски и се разпространява из целия свят. Тази публикация представлява значима стъпка към привличане на по-широковнимание към България и Бусманци. Статията става факт, когато повишеното внимание на международната общност се фокусира върху ситуацията на търсещите убежище в България. Свидетелство за това е значителното място, отделено на проблема в предстоящия годишен доклад на Амнести интернешънъл. В него е отразена и дейността на ПКБИ. Надяваме се това внимание да подпомогне създаването на по-добри условия за търсещите убежище в България!

Декември 2007

Месец декември бе белязан от участие на Клиниката в редица форуми и развитие по някои от дългогодишните дела на наши клиенти. Валерия Иларева представи изследването си „Immigration Detention in International Law and Practice. In search of solutions to the challenges faced in Bulgaria" на провелия се в Мадрид на 14 и 15 декември семинар относно бежанското и имиграционното право. Темба Луис представи изследването си „Another Planet on the Earth: The Rise of Violence and Gangs among Sudanese Refugee Youth in Cairo" по време на международната конференция по случай 25-тата годишнина на Центъра за бежански изследвания към университета в Оксфорд. В София Диана Даскалова представи Клиниката по време на международния семинар, организиран като част международен проект „Влиянието на членството в ЕС върху миграционните тенденции и политиката за интеграция на имигрантите на българския трудов пазар" под егидата на Института за икономическа политика и Германския Маршал фонд.

През декември започна процедурата по значимо дело, което се надяваме ще спомогне за подобряване условията на принудителното задържане в България. Делото е заведено пред Европейския съд за правата на човека. Клиниката би желала да благодари на високоуважаваният адвокат Д-р Мария-Тереза Гил-Базо и Г-ца Нуала Моле, директор на AIRE Център в Лондон за съдействието им при изготвяне на жалбата.

В заключение, Клиниката има удоволствието да поздрави новия член Ралица Виячка за присъединияването й към екипа като административен асистент. След чудесното коледно парти, което имахме, всички ние от Клиниката Ви желаем Весела нова година!

Welcome to the first instalment of what I hope will be monthly updatesfrom the Legal Clinic for Refugees and Immigrants (LCRI).

October 2007

October has been an exciting month of transition at the Clinic. Clinic lawyer Valeria Ilareva began a year-long residence in Madrid, Spain while researching for and writing her doctoral thesis. Her presence at the Clinic is missed, although she continues working on cases and developing Clinic initiatives. Themba Lewis joined Diana Daskalova at the Clinic filling the role of Clinic Manager and bringing enhanced capacity to the daily operations and strategic long-term planning. Simultaneously, the call for new members has resulted in a number of new student faces in the Clinic and brought fresh energy to compliment the experience of continuing members.

Clinic members Nezabravka Vazelova & Themba Lewis participated as representatives of LCRI on plenaries 'Integration and the Rights of Immigrants' & 'Labor Market' during the Manfred Worner Foundation & Centre for European Refugees, Migration and Ethnic Studies (CERMES) Workshop: "Integration of Immigrants and their Organizations" at Club Vladaya. The weekend-long conference invited representatives of immigrant communities and service providers to gather and discusscritical issues facing immigrants and organizations and to establish networks of communication and support.

Additionally, in response to an appeal submitted by Clinic lawyer Valeria Ilareva describing rights infringements and obstructions to legal access in the Busmanci immigration detention centre, the Sofia Bar Council undertook proceedings in October to call upon the Supreme Judicial Council to declare the impediment of access to Busmanci detainee files unconstitutional.

November began with the celebration of the release of two Clinic clients from the detention center at Busmanci. One of these had been detained for over two years, the second for over six months.

On the 7 of November the Clinic was proud to be invited to participate in a public debate on 'Being a Refugee in Bulgaria' focusing ondetention and the conditions surrounding the Busmanci center. The event, hosted by the Red House Center for Culture and Debate, was very well attended and was sponsored and organized by the Center for European Refugees, Migration and Ethnic Studies (CERMES) at the New Bulgarian University with the help of the Trust for Civil Society inCentral and Eastern Europe. Nezebravka Vaselova represented the Clinic and Clinic volunteer Peter Chikoyi presented the case for those detained.

November also saw the beginning of classes for 17 enthusiastic new Clinic members. These classes will focus on International and Bulgarian frameworks of Human Rights, Refugee, and Migration Law as well as cover specific aspects of the migration experience - including focus on working with survivors of torture and the dynamics of international humanitarian assistance and organizations.

To close, November saw the publication of "Bulgaria's Treatment of Asylum Seekers" by Clinic Board Member Valeria Ilareva in the internationally respected journal, Forced Migration Review. This publication appears in French, English, Spanish and Arabic and is distributed worldwide - the article represents a significant step in bringing Bulgaria and Busmanci to much broader attention. This article comes at a time when increasing international attention is focused on the situation facing asylum-seekers in Bulgaria, as evidenced through a significant chapter in the upcoming Amnesty International yearly report. The chapter features LCRI cases prominantly, and we hope this attention can help facilitate better conditions for asylum-seekers in Bulgaria!

December 2007

December was marked by Clinic member participation in a number of external forums and a number of developments with long standing Clinic cases. Valeria Ilareva presented her paper "Immigration Detention in International Law and Practice: In Search of Solutions for Bulgaria" at a Madrid conference on Immiration and Asylum organized by the Institute of Migration Studies, and Themba Lewis presented his paper "Another Planet on the Earth: The Rise of Violence and Gangs among Sudanese Refugee Youth in Cairo" as part of the Refugee Studies Centre 25th Anniversary International Conference at the University of Oxford. In Sofia, Diana Daskalova represented the Clinic at an international workshop as part of the Economic Policy Intitute and German Marshall Fund international project, "The Implication of EU Membership onImmigration Trends and Immigrant Integration Policies for the Bulgarian Labor Market".

December also saw the initial steps in what we hope to be asignificant case dealing with detention conditions in Bulgaria. The case is being brought before the European Court of Human Rights, and the Clinic is grateful for the kind assistance of highly esteemed human rights lawyer Dr. Maria-Teresa Gil-Bazo, and Ms. Nuala Mole, Director of the A IRE Centre in London.

Finally, the Clinic is pleased to welcome new member Ralitsa Viyachka to the position of adminstrative assistant, had a wonderful Christmas party, and is wishing everyone a happy New Year!
